1. What you are buying
Each order is a one-off purchase of digital content: a company file compiled from official public registers and delivered electronically, normally within minutes. Because fulfilment begins immediately and the deliverable is tailored to your request, the rules below apply.
Ordering a file involves two separate payments that go to two different recipients, and they are treated differently for refunds:
- Our own fee — one ESearchCy credit. Credits are bought from us in advance through our payment provider, Stripe. This is money we receive, and it is the part we can refund.
- The €10 file-study fee — paid to the Registrar. You pay this yourself, with your own card, on the Registrar's JCC payment page. It goes directly to the Department of the Registrar of Companies and Intellectual Property. It never passes through our accounts, and we cannot refund it once the payment has been submitted.
2. Right of withdrawal (EU/EEA consumers)
If you are a consumer in the EU/EEA, you normally have a 14-day right of withdrawal for online purchases. By placing an order you expressly consent to immediate performance and acknowledge that you lose the right of withdrawal once delivery of the digital content has begun. This is stated at checkout before you pay.
3. Our own fee — the ESearchCy credit
The credit reserved for an order is returned to your account balance automatically, as soon as the order ends without delivery. This happens where:
- you cancel the order before it has been delivered;
- we cancel your order for any reason before delivery;
- we cannot locate or retrieve the requested company file (for example, the registry holds no such record, or retrieval fails and cannot be completed within a reasonable time); or
- the delivered file is materially incomplete due to a fault in our service, and we cannot cure the problem by redelivery within a reasonable time.
A returned credit can be spent on any other company, so in most cases you do not need to contact us at all.
If you would rather have your money back than a credit — for instance because you do not intend to order again — email us and we will refund the corresponding credit purchase to your original payment method through Stripe. Duplicate credit payments taken in error are always refunded in money, not credits. Where only part of an order is affected, we may refund or return that part.
4. The €10 Registrar fee — what we can and cannot do
Once the €10 has been submitted on the JCC page, the money is with the Registrar and the file-study has been paid for. We do not hold it and we have no power to reverse it, so we cannot refund the €10. We are not trying to keep anything here: it is simply not ours to give back.
What we do instead, at no extra charge from us:
- We try to get you the file you have already paid for. An order that failed or was cancelled after a payment was recorded — or after the Registrar issued an order number — can be recovered from My orders, and we will run the retrieval again against that same paid file-study. You do not pay another €10.
- Recovery uses one credit again, because the retrieval work is done again. If the original failure was our fault, tell us and we will return that credit.
- If retrieval still cannot be completed, we will give you the registry order reference and the payment details we hold and help you raise it with the Registrar directly, so that you can ask them for the file or for a refund of their fee.
If you cancelled before the €10 payment was made, nothing was paid to the Registrar, there is nothing to recover, and your credit simply comes back.
5. When we do not refund
We do not refund where:
- the €10 Registrar fee has already been submitted — see section 4;
- the file was delivered as described and the underlying registry data is simply not what you hoped to find (accuracy and content of public registry records are outside our control — see the Disclaimer);
- inaccuracies originate from the public register itself;
- the order has been delivered and the withdrawal right has been waived as described above.
Nothing in this policy limits your mandatory statutory rights, including remedies for digital content that is not in conformity with the contract.
6. How to request a refund
Credits come back on their own — you only need to write to us if you want money back rather than a credit, or if something has gone wrong.
Email info@esearchcy.com from your account email, quoting the order reference, within 14 days of the order. We aim to respond within 2 business days. Approved refunds of our own fee are returned to the original payment method via our payment provider (Stripe); banks typically take 5–10 business days to post them. Refunds of the Registrar's €10 fee, if any, can only be made by the Registrar.
7. Chargebacks
If you dispute a charge with your card issuer while a refund request is open with us, we may pause the request pending the card network process. Fraudulent chargebacks may result in account suspension.
